CBP issues withhold release order against Chinese Fishing Vessels

CBP, on May 28, 2021, issued a Withhold Release Order (WRO) against Chinese fishing fleet Dalian Ocean Fishing Co., Ltd (Dalian) on the basis of forced labor in the entity’s operations.

This is the first WRO issued against an entire fishing fleet.  The WRO instructs CBP personnel at all US ports of entry to detain all tuna, swordfish, and other seafood harvested by vessels operated or owned by Dalian. CBP indicated this WRO obviously covered downstream products from the fleet such as canned tuna and pet food. 

WRO issued by the US government when information is received that reasonably but not conclusively indicates goods were made in whole or in part using forced labor.  Detained merchandise must be exported immediately, or a substantial submission made that provides specific information showing the goods were not made using forced labor.  To obtain a release subject to a WRO, a certificate of origin along with the detailed statement explaining the merchandise’s production and supply chain must be submitted to CBP.  Decisions to release will be made on a case by case basis.
