On August 7, 2020 the US Trade Representative (USTR) announced an extension of exclusions to Section 301 $200 Billion Trade Action (List 3) for products originating from China.  

As set forth in the Annex, these exclusions expired August 7, 2020 and have been extended through December 31, 2020.

Some of the product exclusions include the below HTS numbers.

Section 301 Exclusions - Extensions List 2

UPDATE July 31, 2020

The Office of the U.S. Trade Representative (USTR), after seeking comments on whether to extend for up to 12 months exclusions from the Section 301 tariffs granted in July 2019 for certain imports from China, has approved extensions covering the following Harmonized Tariff Schedule (HTS) subheadings and product descriptions:

  1. Polytetrafluoroethylene ((C2F4)n), having a particle size of 5 to 500 microns and a melting point of 315 to 329 degrees Celsius (described in statistical reporting number 3904.61.0090)
  2. Polyethylene film, 20.32 to 198.12 cm in width, and 30.5 to 2000.5 m in length, coated on one side with solvent acrylic adhesive, clear or in transparent colors, whether or not printed, in rolls (described in statistical reporting number 3919.90.5060) 7
  3. Rectangular sheets of high-density or low-density polyethylene, 111.75 cm to 215.9 cm in width, and 152.4 cm to 304.8 cm in length, with a sticker attached to mark the center of each sheet, of a kind used in hospital or surgery center operating rooms (described in statistical reporting number 3920.10.0000) 
  4. Gasoline or liquid propane (LP) engines each having a displacement of more than 2 liters but not more than 2.5 liters (described in statistical reporting number 8407.90.9010) 
  5. Dispensers of hand-cleaning or hand-sanitizing solutions, whether employing a manual pump or a proximity-detecting battery-operated pump, each article weighing not more than 3 kg (described in statistical reporting number 8424.89.9000) 
  6. Walk behind rotary tillers, electric powered, individually weighing less than 14 kg (described in statistical reporting number 8432.29.0060) 
  7. AC motors, of 18.65 W or more but not exceeding 37.5 W, each with attached actuators, crankshafts or gears (described in statistical reporting number 8501.10.6020) 
  8. Position or speed sensors for motor vehicle transmission systems, each valued not over $12 (described in statistical reporting number 8543.70.4500) 
  9. Wheel speed sensors for anti-lock motor vehicle braking systems, each valued not over $12 (described in statistical reporting number 8543.70.4500) 
  10. Apparatus using passive infrared detection sensors designed for turning lights on and off (described in statistical reporting number 8543.70.9960)

  14. Digital clinical thermometers (described in statistical reporting number 9025.19.8040 prior to July 1, 2020; described in statistical reporting number 9025.19.8010 or 9025.19.8020 effective July 1, 2020)

These extensions are effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on July 31, 2020 and before 11:50 p.m. eastern daylight time on December 31, 2020.

Section 301 - $300 Billion Trade Act Exclusions (List 4)

UPDATE JUNE 8, 2020

On June 8, 2020, the US Trade Representative (USTR) announced additional exclusions to Section 301 $300 Billion Trade Action (List 4) for products originating from China.  

As set out in the Annex, the exemptions cover two 10-digit Harmonized Tariff Schedule (HTS) subheadings and 32 specially-prepared product descriptions, which cover 55 separately submitted exclusion requests.  

These exclusions are valid from September 1, 2019 to September 1,2020.  

The excluded HTS subheadings are both within Chapter 52 (Cotton) of the HTS:

  • 5210.11.4040 – Woven fabrics of cotton, containing less than 85 percent by weight of cotton, mixed mainly or solely with man-made fibers, weighing not more than 200 g/m²: Unbleached: Plain weave: Of number 42 or lower number: Sheeting.
  • 5210.11.6020 – Woven fabrics of cotton, containing less than 85 percent by weight of cotton, mixed mainly or solely with man-made fibers, weighing not more than 200 g/m²: Unbleached: Plain weave: Of numbers 43 to 68: Poplin or broadcloth.

  3. Submersible pump incorporating a magnetic drive motor (described in statistical reporting number 8413.70.2004)
  4. Centrifugal pumps designed for eliminating condensate, the foregoing not elsewhere specified or included (described in statistical reporting number 8413.70.2090) 
  5. Housings for water pumps of subheading 8413.30.90 (described in statistical reporting number 8413.91.9010)

With these extensions, such products entering the United States for consumption, or withdrawn from warehouse for consumption, on or after June 4, 2020 and before December 31, 2020, will continue to be excluded from the additional duty.

On May 21, 2020, the US Trade Representative (USTR) announced additional exclusions to Section 301 $200 Billion Trade Action (List 3) for products originating from China.  

As set forth in the Annex, the exclusions are reflected in seventeen 10-digit HTSUS subheadings, which cover 33 separate exclusion requests, and 61 specially prepared product descriptions, which cover 70 separate exclusion requests. These exclusions will apply from September 24, 2018 to August 7,2020.

Latest updates on Section 301 List 3 & 4 Exclusions 

On March 20, 2020, the U.S. Trade Representative (USTR) announced that considering the ongoing developments (COVID-19), it would accept requests from interested parties to obtain exclusions from the 25% and 7.5% tariffs. This pertains specifically to companies that either failed to apply by the original exclusion request deadline, and companies whose request had been denied but may be eligible now under the latest (USTR) notice.

Applicants must establish specific and detailed evidence that their exclusion request is for products that are needed in the United States to respond to the virus outbreak (COVID-19).

Focus

  • Medical and/Healthcare Products
  • And/or Products that are connected to or useful in the virus response effort
    • Examples
      • Items Necessary for construction/ upgrading / Maintenance of healthcare facilities and critical infrastructure
      • Inputs and equipment for manufacturing of healthcare-related supplies
      • Industrial and agricultural maintenance supplies and equipment

Does not Cover (Not-applicable to)

  • Does not replace the current exclusion process or the Section 301 exclusion requests that were already submitted

Submission

  • The comments can be submitted regardless of whether the product at issue is subject to a pending or denied Section 301 exclusion request.
  • The Docket is currently available until June 25, 2020, and might be extended if needed by (USTR).
  • The (USTR) recommends that submissions be applied to portal ASAP
    • Opposing comments or Supportive Comments may be posted to published exclusion request three business days after public publication is available on PORTAL.
    • All submissions must include:
      • Identification of the product at issue
      • Explanation or precisely how the product relates to the response effort
      • Must contain the 10-digit Harmonized Tariff
      • Must include the functionality, physical characteristics (dimensions, material composition, and other features)

On March 17, 2020, the US Trade Representative (USTR) announced additional exclusions to Section 301 List 4 of the $300 billion Trade Action for products originating from China covering the items below:

  1. Certain bowls of molded plastic under 3926.90.9990
  2. Disposable graduated medicine dispensing cups of plastic under 3926.90.9990
  3. Certain pads of foam plastics under 3926.90.9990
  4. Single-use sterile drapes under 3926.90.9990
  5. Certain sterile decanters under 3926.90.9990
  6. Cold packs under 6307.90.9889
  7. Disposable shoe and boot covers of man-made fabrics under 6307.90.9889
  8. Certain eye compresses under 6307.90.9889
  9. Certain face masks under 6307.90.9889
  10. Certain gel pads under 6307.90.9889
  11. Certain hot packs under 6307.90.9889
  12. Laparotomy sponges of 6307.90.9889
  13. Patient restraint and safety straps under 6307.90.9889
  14. Single-use blood pressure cuffs 6307.90.9889
  15. Single-use medical masks under 6307.90.9889
  16. Single-use stethoscope covers under 6307.90.9889
  17. Woven gauze sponges of cotton under 6307.90.9889
  18. Electromechanical shoe cover dispenser under 8479.89.6500
  19. Protective articles under 9004.90.0000

  • Certain nonwoven fabrics under 5603.12.0090

  • Disposable graduated medicine dispensing cups of plastics (described in statistical reporting number 3926.90.9990) 
  • Pads of foam plastics, with hook and loop fastener straps, integrated arm protectors, and accessory headrest, body straps, lift sheets, hand grips and face masks, of a kind used for positioning patients during medical procedures (described in statistical reporting number 3926.90.9990) 
  • Single-use sterile drapes and covers of plastics, of a kind, used to protect the sterile field in surgical operating rooms (described in statistical reporting number 3926.90.9990) 
  • Sterile decanters of polystyrene plastics, each of a kind used to transfer aseptic fluids or medication to and from sterile bags, vials or glass containers (described in statistical reporting number 3926.90.9990) 
  • Cold packs consisting of a single-use, instant, endothermic chemical reaction cold pack combined with a textile exterior lining (described in statistical reporting number 6307.90.9889)
  • Disposable shoe and boot covers of man-made fiber fabrics (described in statistical reporting number 6307.90.9889) 
  • Eye compresses, each consisting of a fabric cover filled with silica or gel beads, with or without a hook-and-loop fastener strap (described in statistical reporting number 6307.90.9889) 
  • Face masks, single-use, of textile fabrics (described in statistical reporting number 6307.90.9889)

These exclusions cover goods entered for consumption, or withdrawn from a warehouse for consumption, on or after September 1, 2019, to September 1, 2020.
